1. Acceptance of these terms
These Terms of Use govern access to and use of the public Optiact website. By using the website, you agree to use it in accordance with these terms and applicable law.
If you become an Optiact client, the specific quotation, proposal, order, statement of work, service agreement or other terms accepted for that service will also apply. If there is a conflict, the service-specific agreement governs that paid service to the extent of the conflict.

3. Purpose of the website
The website provides information about Optiact, its services, pricing concepts, educational material and ways to contact or start a project. Public website content is general information and does not by itself create a client relationship, guarantee availability or constitute a final quotation unless expressly stated.
4. Client projects and paid services
Paid websites, web applications, hosting, support, domains, email, maintenance and related services are provided under the terms agreed for the particular client engagement. Those terms may cover scope, deliverables, fees, payment dates, changes, support, service levels, third-party costs, intellectual property, data processing, suspension and termination.
5. Accounts and access credentials
If a service requires an account, you must provide accurate information, keep credentials confidential and take reasonable steps to protect the account. Please notify Optiact promptly if you reasonably suspect unauthorised access or misuse.
6. Acceptable use
You may not use the website or an Optiact service to:
- break the law or facilitate unlawful conduct;
- gain or attempt to gain unauthorised access to systems, accounts or information;
- introduce malicious code, interfere with availability, probe vulnerabilities without authorisation or bypass security controls;
- send unlawful spam, abusive automated traffic or infringing content;
- misrepresent your identity or authority; or
- use Optiact infrastructure in a way that materially harms other users or the integrity or security of the service.
7. Website content and intellectual property
Unless otherwise indicated, the Optiact name, branding, website design, text, graphics, code, educational material and other original content are owned by or licensed to Optiact and protected by applicable intellectual-property law. You may view public content for ordinary personal or business evaluation, but may not reproduce, sell, republish, scrape at scale, modify or commercially exploit protected content without permission except where law permits.
8. Client materials and project IP
Clients are responsible for ensuring that content, logos, images, trademarks, datasets and other materials they provide may lawfully be used for the project. Ownership and licensing of custom deliverables, reusable components, pre-existing tools, third-party software and project materials are determined by the applicable client agreement or proposal.
9. Third-party services and links
Optiact services may depend on third parties such as cloud infrastructure, domain registrars, authentication, payment and email providers. Third-party services may have their own terms, privacy notices, charges and availability commitments. Links to third-party websites are provided for convenience and do not necessarily mean Optiact controls or endorses their content.
10. Website availability and changes
We may maintain, update, replace or discontinue public website features. Temporary interruptions may occur because of maintenance, security work, internet conditions or third-party failures. Any contractual uptime or support commitment for a paid service is governed by the applicable client agreement rather than this public website clause.
11. Disclaimers and limitation of liability
To the maximum extent permitted by South African law, the public website is provided on an “as available” basis and Optiact does not warrant that every page will always be uninterrupted, error-free or suitable for every user's particular purpose.
To the maximum extent permitted by law, Optiact will not be liable for indirect or consequential loss arising solely from use of, inability to use, or reliance on general public website content. Liability relating to paid client services is governed by the applicable client agreement and mandatory law.
Mandatory rights remain unaffected. Nothing in these Terms is intended to exclude a right, remedy, warranty, liability or consumer protection that cannot lawfully be excluded or limited.
12. Privacy and access to information
Our handling of personal information is described in the Privacy Notice. Requests for access to Optiact records under PAIA are explained in the PAIA Manual.
13. Governing law
These website Terms are governed by the laws of the Republic of South Africa. Any dispute will be dealt with by a court or other forum with jurisdiction, subject to applicable statutory dispute-resolution rights.
14. Changes to these Terms
We may update these Terms when the website, services or legal requirements change. The current version will be published on this page with an updated effective date. Changes to an existing client agreement will be handled in accordance with that agreement and applicable law.
15. Contact
Questions about these Terms can be sent to info@optiact.co.za or directed to Optiact on +27 76 197 6484.
